Plain-English summary

  • Marketeer provides software for governed campaign execution. You own your data; we are a processor.
  • You won’t use Marketeer for anything illegal or to spam people.
  • We won’t use your data to train third-party LLMs. AI providers are bound by the same.
  • You can export your data anytime. On contract exit we delete production copies within 30 days.
  • If we have an outage, we’ll tell you. If it’s our fault, we’ll credit you.

1. Definitions

"Marketeer", "we", or "our" refers to Marketeer Marketing Systems Ltd, a company registered in England and Wales. "You" or "Customer" refers to the entity entering into an order form with us.

2. The service

Marketeer is a governed campaign execution platform. The Customer’s use of the service is subject to these Terms, the Order Form, and the Data Processing Addendum (DPA).

3. Acceptable use

Customer agrees not to use Marketeer to: (a) violate any law; (b) send unsolicited commercial messages contrary to PECR / GDPR / CAN-SPAM; (c) target vulnerable individuals or groups in violation of FCA Consumer Duty; (d) attempt to reverse-engineer model weights from outputs.

4. Customer data

Customer retains all rights, title, and interest in Customer Data. Marketeer acts as a data processor and processes Customer Data only on Customer’s documented instructions. See the DPA for details.

5. Service levels

Marketeer targets 99.9% monthly uptime on the standard plan. If we miss the target, Customer is entitled to service credits per the SLA addendum.

6. Confidentiality

Each party will protect the other’s confidential information with at least the same care it uses for its own, and at minimum reasonable care.

7. Fees and taxes

Fees are payable as set out in the Order Form. All fees are exclusive of VAT and other applicable taxes.

8. Term and termination

Either party may terminate for material breach not cured within 30 days of written notice. Upon termination, Customer may export its data; Marketeer deletes production copies within 30 days of confirmed exit.

9. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or exemplary damages. Each party’s total liability is capped at the fees paid in the preceding 12 months.

10. Governing law

These Terms are governed by the laws of England and Wales. Disputes will be heard in the courts of London.
